the distribution of Apps or APIs, and the distribution of contents through SNS or video-sharing services etc. (external SNS etc.) operated by external entities or other institutions, etc.
In the Terms hereunder, "Part 1: Common Rules" set forth the rules common to the Services as a whole, while "Part 2: Types of Services" set forth the rules for each of the Services. In using the Services, the provisions set forth in the "Part 1: Common Rules" shall apply in addition to such rules as provided for each type of the Services.
It is noted that NHK may use the Services for news coverage, program production and publication purposes, etc.

When a user accesses the Services, NHK collects contact information on the user and information on the user's viewing and/or browsing history, etc. (hereinafter collectively referred to as "User Information"). Such User Information collected by NHK will be utilized only to the extent necessary (as to handling of personal information collected on the usage of external SNS etc., rules for external SNS etc. in Chapter 2 shall apply).
Also, NHK will respect users' intention and make full consideration for users who do not want their information collected. And, if there comes an inquiry on the types or handling of information collected from users, NHK will appropriately respond.

NHK may collect User Information by utilizing cookies, web beacons or other similar technologies.
Cookies are tiny data sent to users' web browser when they access the web page. Cookies are used to understand which web pages the users' web browser accessed.

* Use of web beacons
Web beacons are used to collect information of use of web pages, such as the number of visits etc., by embedding a tiny GIF image etc.
Furthermore, in order to collect User Information, NHK may utilize analytical systems, etc. provided by third-party companies. Currently NHK uses the Google Analytics provided by Google Inc. and the Adobe Analytics provided by Adobe Systems Incorporated.
Information to be collected by NHK through utilization of those systems will be solely and exclusively managed and used by NHK, and will not be used by Google Inc. or Adobe Systems Incorporated for their own services nor provided to any other third parties.
User Information collected by NHK under Article 12. may be utilized for the following purposes:

In the Services, any User Information collected will not be referred to the personal information retained for Broadcast Receiving Contract unless individually agreed to do so.
(4) Provision to a Third Party
In the event of a request of disclosure from a court or investigating authority based on a legitimate warrant or violation of the Terms by a user, where it is necessary to protect NHK's or any third person's rights or other requirements, NHK may provide User Information to a third party without a prior consent to the extent of the requirement of laws and ordinances.
(5) Entrusted Services
NHK may entrust services that involve the use of User Information to outside service providers. In such cases, NHK shall conclude a contract with the external service provider that requires the provider to protect the secrecy of User Information and manage it in the appropriate manner.
(1) Storage of User Information
When those stored User Information collected in the Services other than statistical information become unnecessary to use, NHK will erase them as soon as possible. And NHK will erase those personal data collected in surveys or questionnaires to measure audience inclination other than statistical data or comments/opinions from the users, within about three months after the ending date of the surveys or the questionnaires.
(2) Security Measures
Copyright, etc. in the content posted shall be handled as follows:
(1) Copyright shall be vested in the Poster, provided, however, that with respect to any content that is posted with Poster's consent to the Terms, NHK shall be entitled to use, free of charge, such content without limitation of period and/or archive the content and programs produced by use of the content for the purposes set forth below:
(2) In making use of such content posted, NHK may edit a content upon NHK's sole discretion by altering, omitting and so forth to the extent that such editing does not affect the truthfulness and credibility of the content.
(3) At broadcasting or publication of a content, the Poster's name or its designated name may be displayed after obtaining a consent of the Poster.
For the purpose of maintaining the Services in a good condition, NHK shall be entitled to take necessary measures, including suspension or termination of using the Services, whole or a part, without prior notice, when it performs a regular or urgent maintenance, there is a lumped load on the system, or otherwise NHK considers it may cause any disturbance to its operation. In such cases, NHK shall not be liable for any damage sustained by the Poster.
In the event of any of the following items conducted by a specific Poster, NHK shall be entitled to refuse posting from such Poster without a prior notice. In such cases, NHK shall not be liable for any damage sustained by the Poster.
When NHK provides the Services, it may make use of the Internet services operated by third parties outside NHK (hereinafter referred to as "External SNS etc."). In this case, pages, etc. supervised by NHK will be referred to as "NHK Accounts".
(1) Deletion of Comments
NHK may delete, hide etc. comments posted, regardless of the intention of the person making the comment, when the reason specified in "Part 1: Common Rules, Article 4: Prohibitions of the Terms" or any of the following are considered to apply:

NHK is not responsible for the content of comments, etc. posted by users because these originate from the users. Any opinions or questions regarding such content should be addressed directly to the user who posted it. The archiving of posted comments and, when archived, terms of archiving are decided only by the external service provider and NHK has no involvement in these decisions. NHK bears no responsibility for the loss of or damage to such posted comments.
(1) Basic Policy
In the case where a claim is received from a person who believes that his or her rights have been violated by a comment, etc. posted by a user of an NHK Account, NHK shall inform the user who posted the comment and seek his/her opinion, etc. as necessary. If, on this basis, NHK decides that the claimant's rights have been violated, and if such is technically possible, NHK shall delete, hide, etc. the comment, etc.
(2) Procedure for Requesting the Deletion of Comments, etc.
NHK may handle User Information based on the following legal grounds:
1) To perform users' instructions or fulfil the obligations under other contracts with users;
2) Users' consent expressly given to NHK to handle User Information in such manner. Each user may withdraw the consent to this handling at any time; however, this will not affect the lawfulness of any handling activity carried out by NHK before such withdrawal of the consent.
3) To comply with legal and regulatory obligations; and
4) Legitimate interests or those of any third-party recipients of User Information, provided that such interests are not overridden by users' interests or fundamental rights and freedoms.
User Information is necessary for NHK to provide the Service to users, so without such User Information, there is a case in which NHK may not provide the Service to users, in whole or in part.
